When is an affidavit used?

When an office, court, bank or embassy asks you to state a fact on oath because there is no other document to prove it: that two names belong to the same person, that a document is lost, that you are single, or what your address is.

Signing and where it goes

It is signed in front of a notary public or a commissioner for oaths, who records that you swore or affirmed it. In some countries it is written on stamp paper. The signed affidavit is then handed to the office that asked for it.

Points to get right

  • Put one fact in each numbered paragraph, in plain words.
  • State only what you know yourself. A false affidavit is a criminal offence in most countries.
  • Do not sign until you are in front of the notary or commissioner.
  • Use your name and identity number exactly as they appear on your identity document.

How to fill it in

  3. Read it through once more as the other party would read it.

What is the difference between swearing and affirming?

Swearing is a promise made by oath on your religion; affirming is the same promise made without a religious oath. Both have the same legal effect.

Can I write my own affidavit?

Yes. This template gives the usual form. The notary or commissioner checks your identity and witnesses your signature; they do not usually write it for you.

Is this affidavit template free?
