When is a rent agreement for India used?

When a house or flat is let in India. Most residential lets are made for 11 months at a time and renewed, and this is the format owners, tenants and brokers use across the country. Many housing societies, banks and employers also ask for a copy as proof of address.

Signing and where it goes

The agreement is usually printed on non-judicial stamp paper or e-stamp paper of the value fixed by the state, signed by both parties and two witnesses, and often notarised. A lease of a year or more has to be registered, which is one reason the 11-month period is common.

Points to get right

  • Buy the stamp paper in the name of one of the parties and check the stamp value for your state before you buy it.
  • Write the deposit amount, the rent and the notice period in figures and in words.
  • List the fittings and fixtures in clause 11; it settles most disputes when the tenant leaves.
  • Many cities ask the owner to give the tenant’s details to the local police for verification. Check whether yours does.

How to fill it in

Before you sign

These templates are general forms written to save time, not legal advice. The law differs from country to country and changes, and a paper about property, money or employment has legal effect. Fill in every blank, delete what does not apply, check the result against the law where you are, and have an important document reviewed by a lawyer before it is signed.

Questions

Questions and answers

Why is a rent agreement made for 11 months?

Because a lease for one year or more must be registered, which costs stamp duty and a registration fee. An 11-month agreement is usually not registered, so it is cheaper and quicker. It is renewed when it ends.

Is a notarised rent agreement valid?

Yes, for an agreement of less than 12 months. Notarisation records that the parties signed it; it does not replace registration where registration is required.

Is this rent agreement for India template free?

Yes. You can download it in Word or PDF, or fill it in online and print it, without payment or sign up, and no watermark is added.

Can I edit it online?

Yes. Press Open in editor: the template opens as an ordinary document in your browser. Fill in the blanks, change any clause, then download it as a Word file or a PDF.

Is it valid in my country?

It is written in a general form that is used in many countries, but the law differs from place to place. Check it against the rules where you are, and have an important document reviewed by a lawyer.

Is what I type sent anywhere?

No. What you type stays in your own browser on your device. Nothing is uploaded.
