When is an employment contract used?

When a new employee joins, or when an existing employee who has never had written terms asks for them. Many countries require an employer to give employees their main terms in writing, usually from their first day or within a short time after.

Signing and where it goes

The employer gives two copies to the employee; both sign them and each keeps one. The employer keeps its copy in the employee’s personnel file.

Points to get right

  • Minimum wage, working hours, leave and notice are set by law in most countries. The contract can give more, never less.
  • Probation, notice and leave must match the employer’s policy and the law, not only each other.
  • Keep the duties broad enough to allow the job to change, but specific enough that the employee knows what is expected.
  • A restriction on working for competitors after leaving is not included, because it is unenforceable in many places. Get advice before adding one.

Before you sign

These templates are general forms written to save time, not legal advice. The law differs from country to country and changes, and a paper about property, money or employment has legal effect. Fill in every blank, delete what does not apply, check the result against the law where you are, and have an important document reviewed by a lawyer before it is signed.

Questions

Questions and answers

What is the difference between an offer letter and an employment contract?

An offer letter makes the offer and states the main terms. The employment contract sets out all the terms in full and is signed by both sides. Many employers send the offer letter first and the contract before the start date.

Can this contract be used for a part-time job?

Yes. State the part-time hours in clause 3, and scale the leave and pay to those hours as the law requires.

Is this employment contract template free?

Yes. You can download it in Word or PDF, or fill it in online and print it, without payment or sign up, and no watermark is added.

Can I edit it online?

Yes. Press Open in editor: the template opens as an ordinary document in your browser. Fill in the blanks, change any clause, then download it as a Word file or a PDF.

Is it valid in my country?

It is written in a general form that is used in many countries, but the law differs from place to place. Check it against the rules where you are, and have an important document reviewed by a lawyer.

Is what I type sent anywhere?

No. What you type stays in your own browser on your device. Nothing is uploaded.
