When is an affidavit of property ownership needed?
Banks, utility companies, development authorities and courts sometimes want a sworn statement that a property belongs to the person applying and carries no mortgage, loan, dispute or court order. It is asked for with a loan application, a new electricity or gas connection, a building plan, or when a property is offered as surety.
Where it goes
It goes to the office that asked for it, attached to copies of the title papers: the registered deed, the record of rights from the land record office, or the allotment and transfer letters of a housing society or authority. The affidavit confirms what those papers show. It does not prove ownership without them.
Points to get right
- Describe the property the same way the title papers do: plot or khasra number, area, and its mauza, scheme or society.
- If there is any loan or charge on it, declare it. Saying a mortgaged property is free of charge is a serious false statement.
- If the property is owned jointly, every owner should be named, and usually every owner signs.
- Attach an up-to-date copy of the record. Offices do not rely on an old one.

What to fill in
- The name, father’s name, CNIC number and address of the person making the statement
- The facts, each in its own numbered line
- The date, and the signature or thumb impression
- The attestation of an oath commissioner, where the office asks for it

These are general formats to save typing. Requirements differ between offices, courts and provinces, and a paper about property or money has legal effect. Have the final wording checked by a deed writer or lawyer, use stamp paper of the correct value, and get the paper attested or registered where that is required.
