When is an affidavit of legal heirs needed?
After a death, banks, pension offices, employers and revenue offices need to know who the legal heirs are before they release money or change a record. This affidavit lists every heir with their relationship to the person who died, and declares that there are no others.
Where it goes
It is given to the bank, employer or office holding the dues, usually with the death certificate and a family registration certificate from NADRA. For bank balances, shares and property the office will normally also require a succession certificate or letter of administration, issued by the court or, where that service exists, by NADRA’s succession unit. The affidavit supports that application; it does not replace it.
Points to get right
- List every heir, including daughters, the widow or widower and the parents if they are alive. Leaving one out makes the affidavit false.
- Give each heir’s name, relationship, age and CNIC number.
- Do not write shares unless the office asks. Shares are fixed by the law of inheritance that applies to the family, not by the affidavit.
- All adult heirs are often asked to sign or to give their own affidavits.

What to fill in
- The name, father’s name, CNIC number and address of the person making the statement
- The facts, each in its own numbered line
- The date, and the signature or thumb impression
- The attestation of an oath commissioner, where the office asks for it
Before you sign
These are general formats to save typing. Requirements differ between offices, courts and provinces, and a paper about property or money has legal effect. Have the final wording checked by a deed writer or lawyer, use stamp paper of the correct value, and get the paper attested or registered where that is required.
